- Real Estate Litigation
Bringing or defending lawsuits arising out of real estate business. Business partnerships which are breaking up; breaches of purchase or sale contracts; suits to quiet title; suits for adverse possession; foreclosing (or defending foreclosure); suits in partition, and so on. Suits to quiet title after obtaining a Sheriff’s deed at a tax lien sale — and all the steps leading up to that is another sub-specialty.
Note: We certainly can do evictions, but we are not a “bulk filer” — so we’re not the cheapest option in town. However, if there’s a particularly complex and difficult fact pattern and others are not succeeding in getting difficult tenants out, people do come to us for those evictions and we get them done.
- Real Estate Business Structures
We are excellent at structuring real estate investors’ businesses. Simplest are LLC’s — initially perhaps one for flips and one for buy and hold, but expanding from there. We set up trusts as well, including land trusts, even in Missouri where one supposedly is not able to do so. We know how to do it anyway. We can structure joint venture deals among real estate investors, whether as an LLC, a Joint Venture, or some other vehicle.
- Real Estate Financing
We understand real estate financing. We can draft a promissory note and associated deed of trust and get the deal filed for record. Another example is how to buy subject-to and what the documentation should look like, and so on.
- Zoning, Permitting and related matters.
We have assisted with condominium conversions and parcel assembly for land development. We have helped businesses obtain proper zoning or licensing. We understand what real estate inspectors are looking for – and how to bring properties back into compliance.
